Legal Question in Credit and Debt Law in Illinois

credit card debt

I was sued by bank in 2003 for credit card debt. Case was dismissed by agreement of parties without prejudice. Now collection agency is suing me for the same debt. They filed 4 years 11 month after acc last activity (statute is 5y). May I be sued twice for the same debt? Now is almost 6 years since last activity, may they get judgment? I have no attorney; what may I say to judge?

Thank you for answering.

Re: credit card debt

The phrase "without prejudice" means that they can sue you later in time.

You can tell the judge anything which is relevant to the case.
