credit card fraud

if my soon to be xwife charges something with my personal american express card to ebay is she doing a illegal act.ie:illegal use of a credit card. ie:credit card fraud?

You say soon to be ex-wife does this mean that you have a marriage dissolution settlement drafted already? If this is your personal credit card and she is not an authorized user then yes one could say the use is illegal. If you are looking for a court or the police to jump in I doubt that will happen with only one use. I would however make sure she liable for the charge in the divorce settlement.
