What happens if the bank who holds your credit card balance does not have a copy of the original agreement that you signed?

They might have a tough time enforcing SOME of the terms of the agreement, but I doubt you will get a free ride from it. Notice that each time you sign for your credit card purchase, you are agreeing to pay the amount in full. Also, every year or so, they usually send you a copy of the agreement with language that tells you what steps to take if you do not agree to the terms.
