Legal Question in Credit and Debt Law in Illinois

credit debt

I have an outstanding balance for a credit card. The crditor is taking me to court for the total amount left. Unless I give them the balance in the whole amount. I don't have the money, but have paid 1000 and set up payments of 500 for the next two weeks. If I agree to have money taken from my checking, can they still take me to court?

Re: credit debt

If you get the debt paid in full, they will have no grounds to take you to court, or if they do, they would lose because you could prove your payments. However,if this is a collection agency rather than the original creditor, I would be wary about agreeing to pay them, especially if it's not the entire balance.
