Legal Question in Credit and Debt Law in Illinois
Death of Joint participant in checking account
Margaret A. Garcia and--myself had a joint checking account. Margaret had her SS disability as a direct deposit. She died on March 13 2009. SS has been taken care of. Margaret had no insurance or estate. The checking account is with a credit union who has taken all funds from the account and applied them to a Visa credit card with them that was in Margaret's name. They say there are no longer any funds in the checking account and therefore cannot send me any monies which would be used for funeral expenses and then close account. Can they do this when I am noted as joint person in this account? Is this legal?

Re: Death of Joint participant in checking account
Were there any funds in the account that were not Margaret's funds?
