Debt Collections

Can a collection agency garnish wages or freeze you bank account for a debt that is 9 years old and no longer on any of the 3 credit repoters. I have also not received any written communcation from them. They said the do not mail notices but the credit card company has been trying to get in contact with me since 2000.

Before they can garnish your wages or freeze your bank account, they must get a judgment against you. If this has not yet happened, make sure not to ignore and summons that they may serve on you. You will want to contest the debt, when it is that old (or even if you just contest that you owe it). If they were going to garnish your wages or your bank account, and they had a judgment, they are required to send you notice of both types, and your employer and/or bank also would notify you.

The basic statute of limitations on a written contract is ten (10) years in Illinois.
