Deceased Person Credit Card Use

I received a new credit card at my home address for my deceased mother. I threw it away but my 14 year old son opened the mail and activated it. He began using it. He purchased some clothes, payed a cell phone bill, and he transfered part of a balance on my credit card. I did not know about this until there was a fraud alert placed on the card and I caught him trying to call the card company. He has put me and my sister as authorized users on the account. If I tell the card company that my son is responsible, what legal trouble is involved? I am able to pay the money he charged on the card, which is close to $4,000. Because he is 14 I think that there would be no punishment, correct?

This whole situation need to be reviewed by a lawyer. There are probate implications, credit implications and criminal law implications.
