Legal Question in Credit and Debt Law in Illinois

Defaulted Student Loan

I recently received correspondance from an agency holding my loaning that it is defaulted and they are in the process of initiating wage garnishment procedures. The first time that I had contact from a representative from the agency was November of this year, up until that point, the agency had been apparently sending correspondance to my parents address (located in another state than which I reside). Once I found out about the status of the loan, I quickly followed up with a letter trying to establish repayment arrangements. These arrangements must not have been acceptable because the next thing I received was a notice for wage garnishment. I am filing for a hearing, but what other course of action can I take. I can prove that up until this current position I have not had steady employment for three years and that I am willing to work out repayment arrangements. In addition, the wage notification I received says I have until January 7, 2000 to make arrangements, but the representative is saying that because the office will be closed for two weeks during the holidays, I have to make arrangements in December because the likelihood of making arrangements by January 7 are slim. Help!

Re: Defaulted Student Loan

Is there a judgment entered against you? If not, I don't see how they can garnish your wages.
