other defendant not served
What happens in an arbitration case when my ex-husband was never served. This is a lawsuit for our child's medical bill, whereby the residential facility of substance abuse led us to believe they can bill our insurance company under the mental health code. Later we find out they are not licensed for mental health. When I went to court 30 days ago, the judge told the Plaintiffs attorney to serve the other defendant (my ex-husband) we go to court in 2 days and he was never served. I filed an answer and affirmative defense and the plaintiff answered the affirmative defense denying most allegations. I am pro-se because no attorney would take the case stating it would cost more to defend me than the 18,000.00 lawsuit. I really appreciate any answer you can help me with.

If he was not served, then no judgment can be entered against him.
