Legal Question in Credit and Debt Law in Illinois

Fair Debt Collection

Hello, I had some car repairs done back in August 08 and the amount for repairs was $1100 as of current 3/09 my balance is $270.00, today the people I owe money too called my employer and discussed my personal debt with my boss and explained to them how disgusted and pissed off they were etc. I sell promotional products and mentioned as well they would no longer do business with us as well as not give us a good name-can they do this and if not what can I do about that-they embarrased me just to collect money and I could possibly lose my job. Please help?

Re: Fair Debt Collection

I assume you are referring to the Fair Debt Collection Practice Act. Unfortunately, this act only applies if the debt collector is collecting the debt of someone else. If they are attempting to collect their own debt, it does not apply. Some states have extended this to anyone collecting a debt, but Illinois has not done so. It seems pretty stupid of them to do something which could cost you your job, since you would not have an income to pay them if they were successful. All I can think of to help you is depending on what was said, you might have a slander case.
