Legal Question in Credit and Debt Law in Illinois

Final Payment?

I am owed $12,646.00 for which I have a signed document and have received 11 payments on. On the last payment I received the debtor wrote ''Final Payment'' in very small letters, under the routing numbers on the check. I did not see it, and now the debtor says because I cashed the check, he is paid in full. The original debt was $26,931.00 and the balance as mentioned above is $12,646.00. Can he do that?

Re: Final Payment?

No, he cannot. But isn't he just the most clever person in the world. What a twit. Absolutely amazing. I would be happy to discuss this matter with you.
