Legal Question in Credit and Debt Law in Illinois
Financial Nightmare
I have been divorced since 2006, and I was left with all of the financials my ex wife and I had together. I made some bad financial and personal decisions, and these are the biggest things I am facing. I moved to the Chicago area to take on a job that I lost in October. I have a checking account that is at least $1000 in the hole. I have a car loan that is 5 or 6 months behind, and they are looking for me. I feel really stupid about this one, but I was taken in an internet scam for $5000 dollars involving a fraudulant money order sent to me to cash for what I thought was helping a orphanage in Africa, and after doing research, found that 1000's of people had been stung by the same thing. So I have defaulted on the loan the bank setup for me to pay it back, and now they are looking for me too. No one knows my address in Chicago, but I want to take responsibility for my stupid mistakes. I also tried using payday loans to help get me through, and since my bank account is a mess, they are in default also. I can't claim bankruptcy, my ex-wife and I claimed in 2003 before she left me. I have yet to find a decent job to help get me back on track. I want to be responsible for this, but I don't know where to start. HELP!!!

Re: Financial Nightmare
Well, I am not sure what your question is. If you cannot pay the loan back, you can't pay it. Bankruptcy might be the best option.
Re: Financial Nightmare
The good news is that you are judgment proof. They can't send you to jail for owing money.
The bad news is that the obvious choice ch 7 bankruptcy is no longer an option.
However, you are still eligible to file a chapter 13 bankruptcy and obtain a discharge.
Eventually the repo man will catch up to you on the car.
So when you start working again, file the chapter 13 and get your discharge.
