Legal Question in Credit and Debt Law in Illinois

frozen bank accounts

Can a creditor have bank accounts frozen on a debt without serving the debtor with a summons to appear in court? I guess I'm asking the legal process the creditor must go through to freeze assests. Thanks for your time.

Re: frozen bank accounts

If judgment was entered on the debt then the creditor can go ahead with a bank citation. The process is that the bank is served with the papers usually by certified mail and then copy of those papers are mailed to your last known address. That is all the notice you are required to receive under the law.
