Legal Question in Credit and Debt Law in Illinois
gifts to siblings before death
My brother is about to die from a liver disease. He wants to gift some of the furniture in his home and his car to me. He currently is in a nursing home without insurance. Am I liable for nursing home costs or hospital expenses? I did not sign any forms being a responsbile party. I did agree to sign the title of the car to appease my brother. It is a 2004 car, not a classic or luxury model. My relatives are concerned that the court or a collections agency will approach me or put a lein on my home for costs not paid by my brother.

Re: gifts to siblings before death
I am sorry to hear about your brother.
As long as you do not sign any documents which say you accept responsibility for the medical bills then there is no way any one can demand payment from you.
When your brother dies then the only entity responsible for the bills would be your brother's estate You mention your brother has a home. Is there anyone else on the deed besides himself? Are there any bank accounts, saving bonds or other assets? If you have any doubts I suggest you make an appointment with a probate attorney to discuss your concerns in greater detail.
