Legal Question in Credit and Debt Law in Illinois

can the government/ banks/ credit collection agencys, raid a persons disability check, and a small pension? I owe under $4,000.00 having not paid any amt., in 4 months. I am on medicare. I have cancer, 2 operations, since December, 4 hospitalizations, in addition, diabeted type two, insulin dependent, majot depression, hypertension, etc. i will be 65, on 4-8-2010..I have ony bills, no assets.

I take 14 drugs a day to survive. the president has said he is going to give banks and collection agencies, the power to collect through medicare disability, social security, and pensions. has this bill passed the congress yet?

You've asked multiple questions in one sentence. First, collection agencies can't get to your assets without first suing you and obtaining a judgment. Most other collectors can't just storm in and take your money either. They are required to go through a judicial or administrative process. You will have plenty of warning before your bank accounts are actually taken control of by a creditor.

Further, in IL social security and pensions cannot be touched by creditors. If brought to suit please show up and explain all you receive is social security and pension and you will be considered judgment proof.
