Legal Question in Credit and Debt Law in Illinois

Gym Membership

I signed a gym membership for a year. I stopped going after about 9 months. After the year was up my credit card expired as well so I didnt bother to think about it anymore since I wasnt going to the gym. The contract had a clause that it would then go month to month after that, my number had changed so when they couldnt get a hold of me once they werent getting paid to tell me that it was being charged still. Ive paid the year I signed up for but its been 6 months since then and they want me to pay $250 for a membership that I havent been to in over 9 months. I learned this all because they finally sent a letter to an old address of mine from a collection agency. Do I have any legal recourse?

Re: Gym Membership

What recourse you have depends on the terms of the contract. Does it say that if your credit card expires and they can't contact you that the membership will be terminated? I'd be inclined to say they can probably pursue the membership fees because you did not contact them to cancel, however, it depends on the terms of the contract.
