Legal Question in Credit and Debt Law in Illinois
judgement
I have a credit card debt I am unable to pay.I was told it is going to be charged off & sent to an attorney for judgement.I told them I'm ill & unable to return to work &
this is my debt alone not my husband's.They say they can go after my home, car, bank accounts. My home & car aren't paid off. The checking account is in both my husband's & I's names. My husband is concerned that if he dies & I inheirit
the house ect. they'll take it. What can they do and how long do they have to collect?

Re: judgement
If they decide to collect on the debt, then they will try to find assets of yours with which to pay the debt. Most commonly, they try to garnish your wages or your checking account. In some cases they may try to go after your home and car. I am curious as to how much you owe.
The two main ways to eliminate this debt are to attempt to negotiate a payment schedule with them, or file bankruptcy to fully eliminate the debt without having to pay them a dime. You can also try some form of credit counseling, however an individual's success with this can be mixed.
I would be happy to discuss this matter with you.

Re: judgement
I agree with Mr. Hunt's reply - try negotiating with the company - they will usually work out some sort of payment plan - before a court will order such attempts to obtain money through your assets, it will consider your financial situation and try to work out a payment plan with you.
