Legal Question in Credit and Debt Law in Illinois

legal contracts

i got a law suit from a laywer demanding money for services provided.

1. i do not have a contract/aggrement with him.

2,. he is trying to hold onto Quantum Meruit knowing he never had a contract with me, and based it on verbal aggrement. which i never had one with him.

How can I fight this? what is in the law that i can reffer to to dismiss this claims.

Well, if the lawyer did work for you then you have to pay him. In most cases, a lawyer does not need to have a written contract to get paid... an oral agreement is enough. And even if there was no oral agreement about payment, quantum meruit demands he be paid something. If you feel he did not do quality work, or that he is overcharging, then you may have a basis for refusing to pay.

Perhaps you should hire an attorney to explain to you what "Quantum Meruit" means.
