Liability if Dr. does not file ins. claim or send itemized bill

A Dr. I went to for a brief time did not send my bill to my insurance company and did not send me an itemized bill that I could file until it was to late. Three years later a collection agency is threatening to take me to court for 3 times the amount my ins. would have paid if I don't pay up. Can I be held responsible? The dr. has since filed bankruptcy.

The general concept is that you are responsible for any bills not paid by your insurance company. However in your situation I would immediately call your insurance company and demand to speak with a supervisor. Inform them of this situation. I would then contact the collection agency and tell them that you are disputing the bill---you should send them a letter of dispute via certied mail with return receipt requested.

I would then follow up with the insurance company every week until it is resolved.
