Legal Question in Credit and Debt Law in Illinois

Medical Bills

My wife had a surgery 10 years ago at a time when she had no insurance. The hospital told her that even though she had no insurance she could pay the bill $25 dollars a month for as long as it takes to pay it off. She agreed to have the surgery and paid her $25/month for three years and then they turned it over to a collection agency and she continued to send them the $25 for 7 more years with no problems. Today the collection agency contacted us and wants her to pay $200/month and wants my wife to fill out a form stating how much she makes. Is this legal, they claim it is and say if we don't cooperate the will sue us for the full balance.

Re: Medical Bills

It sounds a bit dubious. However, whether they can do this depends on the contract your wife signed with the hospital, if any.

Re: Medical Bills

It sounds strange and I would not readily comply. You stated your wife agreed to $25 per month - if you have this in writing, that would be ideal. However, you may even be able to make a case based on your and their actions for the last seven years. Also, doublecheck your initial agreement with the hospital regarding payment of bills.
