Legal Question in Credit and Debt Law in Illinois

Medical Expenses Regarding Minor Child

A judgment has been filed against me by a collection agency regarding payment of medical expenses for my then minor child. These are expenses incurred when by son was a minor living in Illinois with his dad, I live in Kentucky. My exhusband filed bankruptcy and now this collection agency is coming after me for the total sum of these bills all at once. I have been paying $20/month. Since the first of the year, however, this collection agency has requested that I now pay these bills in full; this started when I missed ONLY a payment. It was at that time the agency got nasty and started telling me to pay in full and have sought legal action against me. Is it possible for: 1) Them to come after me for the expenses of our son's medical treatment when I was living in Kentucky and did NOT sign him in for the treatment. 2) The collection agency to come after me for payment in full on medical expenses (it has always been my understanding that if one is making every effort to pay medical bills and not ruthlessly missing payments you cannot be sued to pay in full). Please try to respond in a timely manner if you would be so kind, as there is a date to which I must respond to the collection agency's attorney.

Re: Medical Expenses Regarding Minor Child

You must start with the paperwork - did your husband include these bills in his bankruptcy? Did he have sole custody? I would need more details to give you a full answer. Don't let a collection agency intimidate you. If you entered into a $20 per month arrangement and broke it by missing a payment, they have a right to accellerate probably. But, again, it is back to your paperwork and what you signed for.
