Legal Question in Credit and Debt Law in Illinois

We have an outstanding loan of $5,000 from a family member. We have tried calling and he always says he is going to get it to us. This has been going on for 3 years. We would like to know what our next step would be. The loan is on a document that has been notarized. It is for $5,000.

Two choices:

1. Let it go, he's family.

2. Sue him. Whether your document is adequate depends on what it says, not on whether it is notarized.
