Legal Question in Credit and Debt Law in Illinois

Payment Dispute

Several years ago (about 5) we purchased a Satillite Dish. The contract was set up where we would make 60 $50.00 payments. One day when I was making a payment I noticed the Balance had hardly decreased at all. I figured up how much I had already paid and it should have been paid off. We had moved shortly after purchasing it and we could not find our contract. When I contacted the company and requested a copy they said they only kept the contracts for two years and then threw them out. I told them I would make no more paymenst until they sent a copy which they still refused to do. Then they said they would send one, but what they sent was a copy of the application and not the contract. This is not the company we bought the Dish from, but the company that financed it. I guess what I'm asking is does this sound right to you. Thank you.

Re: Payment Dispute

I would need to see your paperwork to know what your true obligation was, but you have none. the contract is really what defines your obligations. since they dont have a contract either, i dont see how they can expect to enforce any payments. I think i would also withhold payment until i got an accounting and a copy of the contract.
