Legal Question in Credit and Debt Law in Illinois
this was my question:
someone owes me money and has failed to pay me. This person had numerous times to pay me.
I always get put off. And now this person does not answer my calls. I have tried to let this person know id like to get paid the person has contact me back asking me to meet so i can get paid but the does not call or show. I guess there playing games saying will pay and then does not. i was supposed to get paid around christmas time and since then i have not seen this person or got paid. What should i do?
You answered:
Sometimes a letter from an attorney will get folks to open their wallet, but probably less than half the time. Your only other option is to file a lawsuit. The burden will be on you to prove that this person owes you money. There are also statutes of limitations that limit how long you have to sue someone.
New question:
This person has their own business and is well known who hired me to work as their P.A. I did work around christmas time which i was to get a bonus, and have not been paid until now. I just been getting put off. This person has had numerous times to contact me and pay me and has yet to do just that. I have email and text msm. I dont have written documents or checks since i was paid in cash. Can i still file a lawsuit? what should i do?
1 Answer from Attorneys
if you worked for him for cash, and did not declare the income, going to the Dept of Labor will not be a good idea. I would normally suggest you go to them if you have not been paid. If you have an exchange of emails or text messages to support your claim, then yo9u can have an attorney write a letter or sue him in pro se court
