I received disability payments through my employers insurance from 2007 through 2/2010. In September of 2009 I was declared totally disabled and also started to receive Social Security Disability payments in Oct. 2009. They retro the payments from 2/2008 through 10/2009. In Febrary 2009 I received a letter from my jobs disability insurance carrier requesting I pay them back all funds received through the period of the SS Disability settlement payments. I would like to know if this is legal and what recourse do I have. I do not have the money they are requesting and cannot afford an attorney.

You need to look at the policy. It may well be that you can not double dip and you owe the money. If the only think you are receiving as income is the SSD and have no other $, you may well be judgment proof.
