Revive Judgment in Illinois

Just received papers on an old credit union debt from 1994. They are trying to get us for $20K We have just bought a home with my step dad co-signing. Can they try to put a lien on the house even with my step-dads name on the house? What are our rights with this being such an old debt? Should we claim bankruptcy as we can't afford to pay this debt? HELP!

If they have just commenced a lawsuit against you, it may be past the statute of limitations. If they already have a judgment, and they are just reviving it, they don't have to TRY to put a lien against your house. It is automatic, assuming they have filed a memorandum of judgment in the county in which the house is located. Whether or not you should file bankruptcy is not a question which can be answered without much more information. And ultimately, that decision is up to you.
