Legal Question in Credit and Debt Law in Illinois

Rule to Show Cause

Yesterday, I received a citation for failure to appear in court regarding a case against me for credit card collections. The citation states that I must show cause as to why I should not be held in contempt for failure to appear. It says that I must also produce all papers or records set forth in citation to discover assets and failure to do so may result in a finding of contempt and court order for my arrest. This is the first time I am being made aware of the previous court date, I was unaware that I was even supposed to appear the first time. The new appearnce date is only a week away. What do I need to do to address this issue. Is there really a possibility of my arrest if I do show this time. How can I avoid an arrest?

Re: Rule to Show Cause

If you do not show up, there is a very real possibility of arrest. If you actually did not receive notice of the previous court date, then you should advise the judge of this. Bring the documents requested in the citation to discover assets. If they did not provide you with a copy, call the attorney's office and ask them to provide you with one.
