Legal Question in Credit and Debt Law in Illinois

Serving a Minor Court Papers

I am being sued by a doctor I received treatment from. The doctor told me that he had worked with our insurance company before and that the treatments would be covered. In short, they were not covered and I am still trying to get the insurance company to pay.

The collection attorney had to have me served with the judgment papers. I was not aware of the suit so I was not trying to aviod being served. The process server came to our home in the late afternoon/early evening while my wife and I were at work and served our 13 year old daughter with these papers. My question is, can they legally serve a minor?

The short answer is yes. The law states that the sheriff/process server can serve a member of the family who is 13 years or older and mailing a copy of the papers to you at your address. This is called substitute service.
