Legal Question in Credit and Debt Law in Illinois

Small Claims Complaint

I have received an Alias Summons to appear in court for a small claims complaint. It states if I fail to do so, a judgement by default may be taken against you for the relief asked in the complaint. What does this mean & do I really have to show up? What will happen if I don't show up? Thank you for your time.

Re: Small Claims Complaint

The language means just what it says. If you do not show up in court, the judge will grant a judgment in favor of the person who sued you against you awarding whatever the person who sued you asked for. That person could then take further legal action against you to enforce the judgment, collect the money, or whatever. You should show up.

Re: Small Claims Complaint

If you do not show up, there will be an order entered giving the person or company suing you everything they asked for in the complaint.
