Legal Question in Credit and Debt Law in Illinois

Out of State defendant

I was living with an ex-boyfriend and we split up. During

that time we signed an agreement that I prepared

which stated we would each be responsible for 1/2 of

all costs associated with the apartment we were

renting in Mountain View, CA . This document was in

addition to the standard rental agreement for the

apartment. We also included a statement that he

would payback $4800 that he borrowed to pay for rent

and assocated aparment costs as well as others. We

both signed the document. He has since moved to

Illinois. I want to take him to court to get the money, but

am having a hard time determining how to proceed. I

have tried to settle with him, but get no positive

response.

Any information or help would be greatly appreciated.

Yes there is something you can do. This sounds like a breach of contract claim. Basically it sounds like you entered into a contract where he would pay a certain amount of money and in return he was given a place to live.

If attempts at settlement have failed, ten the next step would be to file suit. Since he lives in Illinois, it is possible that you could file suit in Illinois.
