Statue of limitation for credit card debt & filing a motion
I have a credit card debt from 1996. When I went to court I told the Judge I felt the statue of limitations was up on the debt. He responded I needed to file a motion.
How do I file a motion, what should it say and is the statue of limitation up on this debt?

The statute is 10 years on a written contract which a credit card is--but if you have made payments then I believe the statute is extended. If you know you have the debt and you know that you owe it then contact the creditor and make a deal otherwise you will probably be tagged with court costs and attorney fees.
