Legal Question in Credit and Debt Law in Illinois

Unfair Judgement

I co-signed for someone to get a car in 1998. A year later that person was having trouble making payments and they repossessed the car. I was never informed of any of this. I do understand that because I cosigned I was responsible as well and it is lawful for it to go on my credit. My question is now, I have a judgement on my credit report regarding the repossessed car and I was never served with any papers. At the time it supposedly went to court I was not even living in the state any longer. Do I have any rights in this case? I am just now finding this out because I would like to buy a house and it is on my credit.

Re: Unfair Judgement

You need to meet with an attorney so he can review the court documents. If you were never properly served with the summons and complaint then a motion can be brought asking the court to vacate the judgment against you. However, an attorney needs to review the court documents to see how you were served.
