Legal Question in Credit and Debt Law in Illinois

Wage Garnished for Husbands bad Debt

My husband has accumulated bad credit card debt in the thousands of dollars. I was not a co-signer on his credit cards. The collection agency called my job with threatening comments. Does the credit card companies have a legal right to garnish my wages?

Re: Wage Garnished for Husbands bad Debt

Are you absolutely positive that your name isn't on any of the debt? If your name isn't on the debt, they cannot go after you. I would recommend keeping a record of every time they contact you, what transpires during that call, who is calling, and if possible take down phone numbers. If they are telling your employer anything other than asking to speak to you, keep track of that too. And then speak to an attorney who specializes in Consumer Law or FDCPA.
