Legal Question in Credit and Debt Law in Illinois

Widow liable for his debt?

If a husband acquires large amounts of debt in his name only and dies before debts are paid can the creditors come after the widow? If so can the wife take legal action prior to the husband's death to protect herself?

Re: Widow liable for his debt?

Depends on what the debt was for. If there is a family purpose to the debt, there may be liability.

Wife is entitled to a spouses share of the estate (before the creditors)
