Legal Question in Criminal Law in Illinois
2 DUI & Driving on Suspened License
I have two DUI's and going to court for driving on a suspened license in Cook County, IL. However, the driving on suspened license was before the judgement entered on the 2 DUI's (cook county). I recevied Supervison on the 1st and Conditional discharge on the 2nd. If convicted for driving on a suspened license, how will this effect the 2 judgement on the DUI? Also I have not been driving since the traffic stop last year May (9 months) and have no cases pending. Please advise on if I will get jail time.

Re: 2 DUI & Driving on Suspened License
The prospects of jail time really depend upon the basis of your suspension. All driving on suspendeds carry a possible sentence of up to 364 days in jail and/or a fine of up to $2,500. However, the reason for your suspension is something both the state's attorney and the court look closely at in determining your sentence. You certainly need a lawyer. I am a former Cook County Assistant State's Attorney and available for consultation should you see fit.
