accusation of theft

7 months ago, i was fired from a car dealer. I was the mgr. New management came in and said I was stealing gas..Now the owner said he's going to have me sent 2 jail...can he do this???

The owner can ask the state's attorney to charge you with theft.

The manager of the car dealer can't directly send you to jail, however, he could report a criminal complaint against you with the local law enforcement agency. If the manager were to report a theft of gas to the police, and the police were to either be presented with some evidence or find the manager's complaint credible, the police could have a warrant issued for your arrest. If you get picked up on a warrant, you will normally have the opportunity to post a bond in order to be out of jail during the pendancy of any criminal case. Depending on the quantity of gas alleged to have been stolen, you could either potentially be facing a misdemeanor or a felony. A misdemeanor theft charge could carry potential county jail time of anything up to 364 days in jail, while a felony charge, depending on the class of felony, could carry 1 year or more in the Illinois state prison.
