Legal Question in Criminal Law in Illinois

I was arrested for a disorderly conduct charge in the state of illinois and not read my miranda rights. Will the case hold up or be dismissed in the courts?

You do not need to be read your Miranda rights unless the police want to question you.

No, your charges will not be dismissed because the police did not read you your rights. However, if the state's attorney intends to use any statements that you made while in custody being questioned by the police, then the Ccourt might grant a Motion to Suppress your statements so that they could not be used in Court against you. In any event, you need to hire a criminal defense attorney to obtain the best possible result in your case. Good luck.
