What happens next
If someone is arrested for writing a check out of an account that is not theirs, in the excess of $5,000, is this a federal crime? What is the punishment if found guilty? What will happen next?

Under the facts you describe, a forger may be prosecuted under state or federal law, if there was any interstate connection. In cases of checks going through the mail or to a clearinghouse, I am unaware of any cases where the courts did not find the interstate connection to trigger federal jurisdiction.
