Legal Question in Criminal Law in Illinois

I have three arrests on my criminal record. All the arrests are at least ten years old. They all pertain to difficulties with a former relative. I have no convictions. In 2004 I attempted to have these arrests expunged. Expungement was denied based on the case People vs. Wells. Recently I spoke to a representative of the Illinois State Police Expungement Department. I was informed that all my arrests are expungable. May I make a second attempt to have these arrests expunged?

It really matters what the exact arrests/convictions are.

Were you convicted?

Or were they just arrests?

You will want to go to the courthouse(es) where your arrests were and get a "disposition" from the clerk. This will be your starting point.

People v Wells simply states that cases are expungeable based on the court's discretion. Having an attorney organize and present your cases to the judge and court will increase your chances of getting your cases expunged greatly. Since you were simply arrested and never convicted you have a good chance of getting your cases expunged. If you received supervision for domestic cases you will have a little more trouble but you still qualify.
