Legal Question in Criminal Law in Illinois

bad checks

my son who is in the military wrote several bad checks. In fact, he ruined at least 3 checking accounts. One of the banks said they were going to prosecute him but they are giving us a chance to pay monthly payments. The problem is we can't afford these payments of 400.00 a month. And this is just one bank. What do we do when the others come after him? Can we file chapter 7 bankruptsy and make smaller payments? Will he be prosecuted if we make smaller payments? He hasn't been paid by the military for about 2 months because of other debt. And I receive only disability.

I agree with the answer previously given. I'd also add that YOU cannot file bankruptcy for your son's debt. Besides, you cannot go bankrupt on a debt created by fraud.

Keep paying, otherwise he'll be prosecuted. Why is he not paying? What other debts disallow your son from receiving his paycheck from the U.S. government for 2 months?

If you can't afford it, tell your son to handle his own affairs, as he is an adult after all. Maybe your son should speak with his JAG attorney.
