Legal Question in Criminal Law in Illinois

Battery Charge

I was summoned to appear in court next week for a battery charge. If I do not wish to accept supervision or plead guilty and I ask for a jury trial and at the jury trial I am found guilty, is it possible to have the guilty charge/sentence (whatever it may be) expunged or is it a permanent criminal record with no possibility of being expunged? P.S. I have never had a misdemeanor or felony before. No record history.

Re: Battery Charge

Hello and Happy New Year. You need

legal representation before you decide

that you want to accept a plea bargain. There are preliminary motions that need to be filed on your

behalf, such as a Motion To Quash Arrest and a Motion To Suppress Evidence. If you plead guilty to a

felony in Illinois, the conviction cannot be expunged; it is permanently

on your record. On the other hand, a

misdemeanor conviction can be expunged

after 2 years. I will be happy to discuss this matter further and in more detail.
