Battery

My son was in a fight. Both boys were hurt. When my son returned to school the other boy called the police and had my son arrested for battrey. Should my son do the same. He is 17 yrs old.

It is probably too late to do that. It should have been done when your son was arrested. Since your son is 17, he is considered an adult under the criminal code of Illinois. He is subject to up to 364 days in Cook County Jail, and up to $2500.00, in fines. Your son will need a lawyer. Please call so we may discuss this more.

It is unlikely the police would pursue a complaint now lodged by your son. It is very rare that criminal complaints are lodged against both parties in an altercation, usually the complaint is lodged in favor of whoever gets to the police first. Your son needs an attorney since he was charged with at least a class A misdemeanor with up to a year in jail and possibly depending upon the circumstances it may be a felony with up to three years in prison.
