Legal Question in Criminal Law in Illinois
my boyfriend and i got into an argument, he was drinking and punched my headboard and put a hole in it. I called the police and had him arrested. If a court date is isussed, do I have to show up to court? what will happen if I don't.
1 Answer from Attorneys
If you don't show up his case could be dismissed because without your direct testimony, even if the arresting officer shows up all he/she might be able to do is testify about what he/she found at the scene after the fact. At best the officer might be able to testify about what, if anything, your boyfriend may have said that incriminates him and that or may not be enough to convict. Normally the prosecutor would contact you about appearing, and you can discuss this with him or her, and he or she may have a better idea of what could happen.
