Whether you can go to jail depends upon a variety of factors icluding exactly what law you are charged with violationg, who the state's attorney is, what court you are in, who the judge is, and what your record is among other factors. In any event, this charge has serious enough consequences that there is absolutely no doubt that you should hire the very best criminal defense attorney you can afford. Do not go to court alone, and do not plead guilty. Hire an attorney!
