I was charge with fraud in 12/2010 how long will it stay on my record if the company does not bring charges to prosecute in Illinois?

Your question is not clear. It sounds like you were accused of fraud by a company. If you were arrested by the police but not prosecuted, you can file a petition to expunge your arrest.
