Legal Question in Criminal Law in Illinois
my charges were amended
I was convicted of a class 1 felony on 10/30/06 and served three years of a six year sentence. I recently found out through a job that I applied for that the background check showed my charges were amended to a class three felony that is either probationary or 1-3 years. I'd like for my record to be changed to show a class 3 felony. Need I have to apply for another job. and would like compensation for the extra time that I spent in prison that I did not have to as well as my parole time to reflect one year not two which is what im doing now. How can I get all this accomplished? It was my first time locked up and that in itself was a traumatic experience and now I feel insult to injury. my parole officer is the one that suggested that I look into this and get what I have coming to me. He said I got lucky that I even found out about it. It's done all the time he says and the person charged never finds out.

Re: my charges were amended
The only way to know for sure is to check the court file. If your charge was amended there would have been a court hearing, and the judge would have had to re-sentence you. You would have had to be present for that. My guess is that the information you got was wrong.
