Legal Question in Criminal Law in Illinois
Class 4 felony damage to property Prosecutor says no deal if we hire an attorney
My son is away at college and has
been charged with a class 4 felony.
My husband - his step-father has
called the prosecutor to find out what
exactly was going on and what we
needed to do. He is willing to work
with us on a plea bargain, but has
mentioned that if we retain an
attorney that all pleas are off the
table. His deal sounds ok, not the
best, but my son did confess to the
police about the crime. What are my
options? He is here in Illinois, but far
west of Chicago.

Something smells fishy here. I would contact a criminal-defense lawyer in the county where your son was arrested who has lots of experience with the prosecutor. And, of course, you don't have to tell the prosecutor that you have talked to a lawyer.

Yo have an absolute right to be represented by legal counsel. Do not let the prosecutor intimidate you into giving up those rights. Perhaps the prosecutor is aware that a defense attorney might get the charges dismissed, and that is why the prosecutor is threatening to take a "deal" off ot the table if you hire an attorney. Without a doubt, you should hire an attorney!
