Condtional Discharge

My boyfriend violated a conditional discharge. I think. He is in jail right now. He got a driving on suspend license ticket and he drove and got caught again...is he going to have jail time?

Driving on a suspended license is a class A misdemeanor that carries up to a year in jail. Regarding the conditional discharge, the judge can resentence him to anything he could have been sentenced to at the time he was conditionally discharged from going to jail. It is difficult to answer your question without all of the facts we need. Of couse a judge could sentence him to up to a year in jail, and the judge on the first charge could also sentence him up to the max on that charge, but that does not mean that either or those things will necessarily happen. Your boyfriend should hire the very best criminal defense attorney he can afford.
