If you're intent on filing charges and getting your $ back, why don't you go to a local police station and file charges. It will be up to the police and then the State's Attorney to decide what kind of crime it may be. And you can file a lawsuit for conversion and/or fraud too, which is your private right of action to money damages equivalent to criminal "theft".
