Criminal-Violation of Probation

I am on 2 years probation for Felony Deceptive Practices/Bad Check. Before I was placed on probation, I wrote another check in another county, arrested and prosecuted and convicted. Placed on probation in county #1, then two months later, sentenced to 2 years in prison which is 6 months. Now county 1 wants to violate probation due to prison sentence. The offense occured prior to being placed on probation. It is my contention that the Petition to Revoke should be dismissed. Am I correct in this assumption?

If the offense took place prior to your being placed upon probation it should not constitute a violation. You did not mention if you were on bond on the first case when the second matter took place. In theory that may have been a violation of your bail bond, which requires that you have no new offenses while on bond. That may be the charge filed against you.
